This AWS Site-to-Site VPN Service Level Agreement («SLA») is a policy for the use of VPN («Site-to-Site VPN») and applies separately to each account that uses the VPN site-to-site. In the event of a conflict between the terms and conditions of this ALS and the terms of the AWS customer agreement or any other agreement with us regarding your use of our services (the «Contract»), the terms of this ALS apply, but only to the extent of such a conflict. The terms used in this agreement, but which are not defined here, have the meaning of the agreement. The duty of service does not apply to the unavailability, suspension or termination of AWS Direct Connect or other AWS Direct Connect performance issues: (i) caused by factors that are not subject to our proper control, including force majeure or related issues outside the demarcation point of AWS Direct Connect; (ii) resulting from voluntary actions or inaction by you or others (for example. If availability is influenced by factors other than the factors used in our calculation of the actual operating percentage, we may, at our discretion, issue a service credit taking these factors into account. In addition, the service obligation and this ALS do not apply to AWS Direct Connect services that are accessible through the DIRECT Connect partner integration of the AWS Partner Network (APN) with hosted connection or hosted virtual interface models.
